Privacy Policy

BookLocalWork in New Zealand is a website at booklocalwork.co.nz (the "site") operated by [KIWIORANGE LEGAL NAME], New Zealand Business Number (NZBN) [NZBN], of [NZ ADDRESS] ("KiwiOrange", "we", "us", or "our"). KiwiOrange operates the site in New Zealand under a licence from SMCI Media, LLC, a Florida, United States limited liability company that owns the BookLocalWork software and brand. This policy explains how we collect, use, store, and share personal information, in accordance with the Privacy Act 2020.

1. Who this covers

This policy covers everyone who uses the site:

It does not cover BookTreeWork or any other dedicated trade software, which is a separate product with its own privacy policy.

2. If you send a contact request to a tradie

What we collect: your name, telephone number, email address if you provide one, the suburb or address where the work is needed, a description of the work, and any photographs you choose to upload.

Why: solely to pass your request to the tradie you selected.

Who sees it: the tradie you contacted, and KiwiOrange as operator of the site. We do not sell this information, we do not use it to advertise to you, and we do not add you to a marketing list.

3. If your business is listed in the directory

Where listings come from: public sources, including open business data and the contact details a business publishes on its own website, Facebook page, or public register.

What we hold: business name, suburb or region, telephone number, website or Facebook page, a registration or licence number where one is publicly listed, and a published business email address where one was found.

To correct or remove a listing: email us at the address in section 11. We correct listings on request and remove them on request. No reason is required.

4. If you are visiting the site

We operate a first-party analytics beacon that records the page viewed, the referring site, the general location, and the device type. There are no third-party advertising trackers, no advertising pixels, and no cross-site profiles on this site. When you click through to a listed tradie, we count the click so that we can tell that tradie how many people were referred to them.

5. Who we share information with, and overseas disclosure

No one else receives personal information from us. We do not sell personal information, and we do not share it for behavioural advertising.

Some of the disclosures above mean your information may be held or processed overseas, including in the United States. In accordance with information privacy principle 12 of the Privacy Act 2020, before we disclose personal information to an overseas person, we take reasonable steps to be satisfied that the receiving party either is subject to privacy laws providing comparable safeguards to the Privacy Act 2020, or has otherwise agreed to protect the information to a comparable standard, for example through its own published privacy and security commitments.

6. The Information Privacy Principles

The Privacy Act 2020 sets out 13 Information Privacy Principles (IPPs) governing how agencies collect, hold, use, and disclose personal information. In summary, and as relevant to this site:

IPP 1–4We collect only the personal information needed for the purposes set out in this policy, directly from you wherever practicable, lawfully, and in a way that is not unfair or unreasonably intrusive.
IPP 5Information is stored securely, as described in section 8.
IPP 6–7You may ask to see the personal information we hold about you and ask us to correct it, as described in section 9.
IPP 8We take reasonable steps to check information is accurate, up to date, and relevant before we use it.
IPP 9We do not keep personal information for longer than it is needed, as described in section 7.
IPP 10–11We use and disclose personal information only for the purposes described in this policy, except where the Privacy Act 2020 allows otherwise.
IPP 12Overseas disclosure is handled as described in section 5.
IPP 13We do not assign any unique identifier to you other than what is strictly necessary to operate the site.

7. How long we keep information

Contact requests and any photographs attached to them are kept only as long as needed to connect you with the tradie you contacted, and are deleted after a reasonable period once that purpose is served. Directory listing information is kept for as long as the business remains listed, or until removal is requested.

8. Security

Information is encrypted in transit and at rest, and access is limited to what is needed to operate the site and respond to your requests.

9. Access, correction, and your other rights

Under the Privacy Act 2020, you may ask us to:

Email the Privacy Officer at the address in section 11 and we will respond within the timeframes required by the Privacy Act 2020.

10. Privacy breaches

If a privacy breach occurs that has caused, or is likely to cause, serious harm, we will notify the Office of the Privacy Commissioner and any affected individual as soon as practicable, in accordance with Part 6 of the Privacy Act 2020.

11. Privacy Officer and complaints

If you have a concern about how we have handled your personal information, please contact our Privacy Officer first. 12. Messages we send

Where we send a commercial electronic message, it will identify who sent it, include accurate sender details, and include a functional unsubscribe facility, in accordance with the Unsolicited Electronic Messages Act 2007.

13. Children

This site is intended for adults arranging trade work. It is not directed at children, and we do not knowingly collect personal information from children.

14. Changes

If this policy changes, the date at the top of this page changes with it.
